Analysis of the current state of legal and regulatory adjustment of labour relationship in pharmaceutical sector of health care field

Abstract

The results of the analysis of norms of legal regulation of labor relationship of employees of the pharmaceutical sector of healthcare determining the specificity of their work are given in the article. In order to determine the main peculiarities of the workers’ activity regulation stated in provisions of the Employment Law Code of Ukraine and the draft of the Labor Code of Ukraine the criteria for their comparison have been formulated, and a number of significant changes in the field of approaches to the labor relationship regulation has been determined. Thus, it can be argued that these changes, on the one hand, improve employees’ positions giving them a wide range of rights, and on the other hand, the changes, in fact, strengthen employers’ positions despite the increased control over them by the labor union organizations. It has been found that the specificity of the legal regulation of the pharmacist’s activity includes requirements of conformity to qualification demands, availability of professional rights and responsibilities, perquisites, opportunity for working hours reduced and additional paid leave.
